The General Terms and Conditions of Online Sale (the “Terms”) govern your use of the website operated by Brandon Vance LLC through brandonmaxwellstudio.com (the “Website”), including for the sale of Brandon Maxwell products (hereinafter the “Products” or “Product”) to you (hereinafter the “Client”). All Clients wishing to make a purchase from the Website represent and warrant that they are not acting on a commercial basis but rather purchasing the Product as or on behalf of the end consumer, and further represent that they are not a minor. The Terms can change and be subsequently amended by Brandon Maxwell; the respective applicable General Terms and Conditions of Online Sale shall be applied when an order is placed. Therefore, the Client should consult the Terms on a regular basis so the Client is aware of the version applicable when placing orders. By using the Website, you agree to be bound by the Terms as then posted here and on our Website’s Privacy and Terms Page, which is available at http://brandonmaxwellstudio.com/terms

Receipt of Products and Return Policy

Sale of customized and made to order items from brandonmaxwellstudio.com follow the Returns & Exchanges policy listed on their specific product pages.

Items that are not customized or made to order may be returned to Brandon Maxwell within 14 days of receipt of merchandise. Items must be returned in their original condition with all garment tags attached in the branded packaging provided. Returns that have been worn, used, altered, or damaged will not be accepted and may be sent back to you and/or a refund refused.

The Client is responsible for shipping costs associated with return of merchandise. We recommend that the Client insures the return shipment as the Client is liable for damage to the item(s) until received at the Brandon Maxwell distribution center.

If Products purchased on brandonmaxwellstudio.com are received damaged, the Client must notify Client Services within forty eight (48) hours of receipt by email. The Client must provide detailed information and pictures of the defects and keep the original Product packaging and the parcel in the condition in which it was received. Client Services will then begin investigation with FedEx. Please note that this process generally takes between eight (8) and ten (10) business days to resolve.

Any authorized refunds will be credited to the original method of payment. Original shipping charges will not be refunded. On receipt of an authorized return, we shall process the refund as soon as possible.

At this time, purchases cannot be exchanged through brandonmaxwellstudio.com.

Shipping Policy

The Client is responsible for any and all shipping costs associated with delivery of orders as indicated at the time of purchase. The Client shall select preferred shipping method when placing the order. Flat shipping fees apply for Ground and Next Day Air. Please ensure that delivery and billing information is accurate when placing the order as we are unable to redirect shipments. Unless indicated otherwise after the final confirmation of order, the delivery period for Products ordered from brandonmaxwellstudio.com includes the standard lead time indicated on the respective Product page plus time allotted by the Client’s preferred shipping method, i.e. FedEx Next Day or Ground shipping. Orders are processed Monday through Friday, excluding holidays. Saturday delivery is not available. Brandon Maxwell is not responsible for unanticipated delays due to conditions such as weather or air travel delays, and orders being shipped to Alaska or Hawaii may be subject to delay.

Products purchased on brandonmaxwellstudio.com can only be delivered to addresses in the Domestic United States (for clarification purposes, this excludes Hawaii and Alaska). Items cannot be shipped to a P.O. box or APO/FPO address. Deliveries shall be made to the address provided at the time of order placement. The Client is responsible for checking the accuracy of this information prior to final confirmation of the order. Please note that delivery times are estimates and start from the dispatch date.

If information relating to recipients is incorrect, Brandon Maxwell may not be held liable for any delay or failure to deliver an order.

Brandon Maxwell shall retain full ownership of Products ordered until payment has been received in full. Once the Product has shipped, risks of loss or damage to said Products are transferred to the Client.

Product Features

The essential features of the Products offered for sale on brandonmaxwellstudio.com are described on the Product page. Some Products may be available in different colors. Due to the computer processing of images and in spite of the care taken in producing our Product pages, the colors of Products shown on the Website may be slightly different from their actual color. The particular technical specifications and settings of your computer and its display could affect the accuracy of its display of the colors of Products offered on the Website.

We cannot be responsible for general wear and tear and any changes that occur due to the nature of the materials used. With regard to exotic skins, the controlled breeding of exotic species is closely monitored and regulated by an international convention for the preservation of endangered species (CITES). Each skin has a traceability file that specifies its characteristics as well as its precise origin.

Product Availability

Subject to their availability, Products offered for sale together with their prices shall be valid as long as they are accessible on brandonmaxwellstudio.com. If a Product becomes unavailable after placing the order, the Client will receive immediate notification by email to the address provided for the order, and if the Client credit card or debit card (the “Client Card”) has been charged, the full amount charged will be reimbursed to the Client Card used as payment no later than thirty (30) days from the date of the payment.

Prices and Prohibition on Reselling

The prices displayed on brandonmaxwellstudio.com are in U.S. dollars and are intended to be valid and effective only in the United States. The prices displayed do not include applicable taxes, which will be charged to the Client and collected at checkout as required by applicable law. Prices listed on Product pages may be changed by Brandon Maxwell at its own discretion without advance notice. In the event a Product has been listed at an incorrect price, Brandon Maxwell has the right to refuse or cancel orders placed at the incorrect price, regardless of whether the order has been confirmed or the Client Card charged. If Client Card has already been charged for the purchase and the order is canceled, Brandon Maxwell will issue a credit on the Client Card. Clients may purchase any item from this Website for personal use only and without the intention for resale by themselves or any other person. Brandon Maxwell has the right to refuse or cancel orders that exceed a quantity of five (5) of the same item per Client. We reserve the right to refuse orders for any reason without explanation. Brandon Maxwell reserves the right at any time after receipt of your order to accept or decline your order, or any portion thereof, in its sole discretion, even after the receipt by Client of an order confirmation or after Client Card has been charged.

If the credit card has already been authorized for the purchase and the order is canceled, we will issue a credit to the original method of payment. Credit card information will be collected when placing an order.
